AGREEMENT or USER CONTRACT
Refers to this legally binding contract between Best Typefaces and the Licensee, which governs the use of the Font Software. The User Contract consists of three integral parts: The General Terms, the applicable End User Licence Agreement (EULA), and the Order Invoice.
 
BEST TYPEFACES (“We,” “Us,” or “Our”)
Refers to Best Typefaces, the licensor and owner of the Font Software, which grants the licence to the Licensee under the terms of this Agreement.
 
LICENSEE (“You,” “Your,” or “User”)
The individual or entity who has purchased or is using the Font Software under the terms specified in this Agreement.
 
FONT SOFTWARE or FONTS
Refers to the software and typeface designs owned by Best Typefaces and licensed to the Licensee for specific uses as outlined in this Agreement.
 
GENERAL TERMS
Refers to the core provisions and obligations applicable to all licences issued by Best Typefaces, which are included in this Agreement.
 
END USER LICENCE AGREEMENT or EULA or LICENCE TYPE
Refers to the specific licensing terms that outline the rights, restrictions, and conditions for the use of the Font Software as selected by the Licensee (e.g., Desktop, Web, Logo, Trial).
 
ORDER INVOICE
A document issued by Best Typefaces to confirm the specific Licence Type(s) chosen by the Licensee, including usage details and associated fees.
 
THIS USER CONTRACT IS A BINDING AGREEMENT BETWEEN BEST TYPEFACES AND THE LICENSEE, EFFECTIVE UPON DOWNLOADING, OPENING, EXTRACTING, INSTALLING, OR PURCHASING THE FONT SOFTWARE. IF THE LICENSEE DOES NOT AGREE TO ANY PART OF THIS AGREEMENT, THEY MUST NOT USE OR INSTALL THE FONT SOFTWARE.

 

1.1 LICENCE GRANT

This Agreement grants You specific rights to use the Font Software as defined in the applicable EULA(s) and confirmed in the Order Invoice. The Licence is non-exclusive, non-transferable, non-sublicensable, perpetual, and worldwide.

1.2 BINDING AGREEMENT
—
By using, installing, copying, or purchasing the Font Software provided by Best Typefaces, You agree to be bound by this Agreement and acknowledge that all use of the Font Software is governed by its terms.

1.3 INTELLECTUAL PROPERTY RIGHTS
—
The Font Software is licensed, not sold. Best Typefaces retains ownership and all intellectual property rights in the Fonts. You acknowledge that no rights beyond those explicitly stated in the Licence are transferred to You. The Fonts, including their design and software, are protected under copyright and other intellectual property laws. No right, title, or interest in the Fonts is transferred to You under this Agreement.

1.4 PERMISSIONS & RESTRICTIONS OF USE

A. COPYING
The Licensee may create a reasonable number of backup copies of the Font Software for archival purposes only, provided these copies are not installed or used in any active capacity. Licences are perpetual, and the Licensee will have access to the latest version of the Font Software available on Our website.

B. MODIFICATIONS
Only Best Typefaces has the right to modify the Font Software. Licensees are strictly prohibited from modifying, reproducing, or reverse-engineering the Font Software. Any attempt to alter the Fonts voids all rights under this Agreement and may result in legal action. Unauthorised changes will result in Best Typefaces claiming ownership of the altered data. Furthermore, changes to Font names, trademarks, or any element of the Font Software are not permitted and require a Custom Licence, which may only be executed by Best Typefaces.

C. NOT PERMITED USES
The Font Software may not be used for environments beyond the scope of the Licence Purchase, including but not limited to apps, games, ePub, servers, logos, wordmarks, merchandise, film titles, credits, television, online transmissions, or social media. Any such use requires a Custom Licence.
Using the Fonts in commercial letterform products, such as rub-on letters, stamps, stencils, adhesive letters, print-on-demand items, or reproductions for signage and scrapbooking also requires a Custom Licence.

D. ARTIFICIAL INTELLIGENCE
The use of Best Typefaces’ Fonts or any related data for the creation of static images of the Font Software, but also for the creation of new Fonts or Font-based services through AI, Machine Learning, or generative algorithms is strictly prohibited, including automated processes or AI techniques that train deep learning systems to synthesise, generate, or modify Fonts using any data from the Font Software, regardless of the intended processes, applications, or products.

 

E. NFT USE
Embedding or using the Fonts in any form related to NFTs (Non-Fungible Tokens), including the promotion of NFT projects or platforms, is strictly forbidden.

 

F. TRANSFER, CONTRACTORS & VENDORS
The Licensee may not rent, lease, sublicense, or assign the Fonts, nor authorise copying or distribution to third parties without prior written permission from Best Typefaces. If the Licence is used for business purposes, the rights extend only to employees and designated internal contractors under the Licensee’s control, as specified in the Order Invoice. Sharing the Fonts with external contractors, affiliates, or vendors requires additional licensing or written permission from Best Typefaces. Unauthorised transfer or sharing constitutes a breach of this Agreement.

G. SECURITY
You must use commercially reasonable measures to secure the Fonts and prevent unauthorised third-party access.

H. UNAUTHORISED USE AND LEGAL CONSEQUENCES
Any use of the Font Software not covered by this Agreement or the applicable EULA(s) constitutes a breach of contract and may be subject to prosecution. Use of the Font Software without appropriate licensing is considered an infringement and is illegal.

I. USER SUPPORT FOR USE CASES
If the Licensee is uncertain whether a particular use is permitted under their current Licence, they are encouraged to contact Best Typefaces at licensing@typefaces.best for clarification. Best Typefaces will assist in determining whether the intended use aligns with the existing Licence or if a Custom Licence is necessary.

 

J. ETHICAL LIMITATIONS 

At Best Typefaces we are committed to fostering inclusivity and respect within our community. In order to avoid and prevent any perception of bias and maintain impartiality and independence in all aspects of Our operations, any Font Software provided by Us is strictly prohibited from being utilised by, on behalf of, or for the promotion of any of the following entities or purposes:

 

◆ Government agencies or state agencies, including but not limited to governmental bodies at local, regional, or national levels.

◆ Law enforcement or military organisations, encompassing any entities involved in the enforcement of laws or the defence of a nation.

◆ Weapon manufacturers, covering companies engaged in the production or distribution of firearms, ammunition, or related equipment.

◆ Political campaigns, involving activities aimed at influencing political processes, elections, or public opinion through advocacy, advertising, or other means.

 
◆ Religious organisations, while We respect the diversity of religious beliefs, Our Font Software cannot be used to promote any religious messages to prevent any divisive or discriminatory messages. 

◆ Spread of hate messages, it is also prohibited to use the Font Software to spread racist, homophobic, transphobic, or sexist content and messages. We do not tolerate the dissemination of hate speech or discriminatory content using Our Fonts.

This limitation extends to Charities and Non-Profit Organisations whose activities may be funded, representative or associated with any of the above mentioned categories. Consequently, they are excluded from the Free Trial Licence benefits.

 

1.5 TERMINATION
—
This Agreement is effective upon full payment or upon any use of the Font Software, including downloading, copying, or installation. Best Typefaces may terminate this Agreement immediately without notice if the Licensee breaches any terms or if the Licensee enters bankruptcy. Upon termination, refunds will not be provided, and the Licensee must destroy all copies of the Font Software. Termination does not limit Best Typefaces’ right to take legal action for violations. While termination for breach is immediate, Best Typefaces may, at its discretion, issue a notice and allow the Licensee a period to rectify any breaches.

 

1.6 GOVERNING LAW, JURISDICTION & DISPUTE RESOLUTION

This Agreement is governed by the laws of England and Wales. For the purposes of the Sale of Goods Act 1979, Supply of Goods and Services Act 1982, Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and the Consumer Rights Act 2015, Font Software is classified as computer software.

Should any dispute arise, You agree to negotiate in good faith for at least 45 days before seeking other remedies. You may be liable for reasonable solicitors’ fees and associated costs arising from a breach of this Agreement.

 

1.7 REPRESENTATIONS, WARRANTIES & LIMITATION OF LIABILITY

You represent that You are acting as an end-user, not as a distributor or reseller. Best Typefaces warrants that the Font Software does not infringe third-party intellectual property rights. While efforts are made to meet high technical standards, there is no guarantee that the Fonts will meet specific requirements or operate without interruption. The Licensee must test the Font Software prior to deployment.

Best Typefaces will make reasonable efforts to address issues but cannot guarantee a specific resolution timeline.

Best Typefaces is not liable for direct, indirect, incidental, or consequential damages from the use or inability to use the Fonts, including loss of profits or data, even if advised of the potential for such damages.

1.8 BUSINESS & ORGANISATIONAL USERS; AUDITS

Anyone using the Font Software for business purposes warrants they have the authority to legally bind the organisation. Unauthorised individuals will be held personally liable for any breach of this Agreement.

Businesses or organisations with 20 or more employees must allow audits of their Font usage during regular business hours to verify compliance with the Licence Terms. If noncompliance is identified, the Licensee must reimburse audit expenses and pay for any additional required licences within 15 days. This audit right remains valid for one year following the termination of the Agreement.

1.9 USER RESPONSIBILITY

You are responsible for ensuring Font Software usage aligns with this Agreement. Best Typefaces may request usage summaries as necessary to verify compliance, maintaining confidentiality unless needed to address violations. You must inform and obligate employees and representatives to comply with these terms.

1.10 UPDATES
—
Best Typefaces may modify this Agreement as necessary and will notify You of updates. Continued use of the Fonts after notification constitutes agreement to the new terms. Updates are not retroactive, and the most recent version will govern Your Licence.

1.11 LICENCE PURCHASE PRICE
—
The Licence purchase price is non-refundable and specified on the Best Typefaces website. Prices may change without notice.

1.12 PURCHASE CURRENCY
—
All Transactions through Our e-commerce platform are processed in Great British Pound Sterling (£ GBP). For Custom Licences, payments may be accepted in USD ($) or EUR (€). Contact Us for more information.

1.13 REFUND POLICY
—
No refunds or discounts will be issued if the number of Licensed Units or uses specified in the Order is reduced, or if the Fonts are partially or entirely discontinued. Licences are non-returnable, and all sales are final. This policy applies across all Standard Licences and Custom Licences, including any licence upgrades.

 

1.14 CHANGES TO THE EULA

Best Typefaces reserves the right to modify the EULA at any time, with changes published on www.typefaces.best.

 

1.15 CREDITING
—
You are not required to credit the font or designer, but are welcome to do so. If a credits section exists, it is recommended to include:
Typeface: [Font Name and Style] by Best Typefaces. (URL if possible) www.typefaces.best

Best Typefaces reserves the right to showcase public examples of how Our Fonts are used, with appropriate credit where possible. If You wish to share Your project, contact Us at hi@typefaces.best or tag Us on social media.

THESE GENERAL TERMS APPLY TO ALL END USER LICENCE AGREEMENTS (EULAS) AND ENSURE COMPREHENSIVE COVERAGE ACROSS ALL LICENCE TYPES.

 

DESKTOP END USER LICENCE AGREEMENT

 

2.1.1 GRANT OF LICENCE
—
Upon full payment of the non-refundable Desktop Licence Fee, the Licensee acquires a perpetual, worldwide right to use the Font Software on desktop devices. This right is non-exclusive, non-transferable, and non-sublicensable.

2.1.2 LICENSEE INFORMATION & COMPANY SIZE
—
The person placing the order must provide the name of the Licensee or Company using the Fonts and specify the Company Size, which is the total workforce of the company (including employees, shareholders, directors, proprietors, subcontractors, and freelancers that are under the Licensee’s control) across all locations, regardless of their access to the Fonts.

2.1.3 RIGHTS & RESTRICTIONS
—
A. INSTALLATION
The Licensee may install the Font Software on any number of desktop devices (e.g., desktops, laptops, workstations) within the organisation. The Company Size count must not exceed that specified in the Order Invoice.

B. STATIC DOCUMENTS
The Licensee may create static documents (e.g., PDFs) for printing or other non-digital publications. Embedding is permitted only for viewing or printing, not for editing or modification. Documents must be distributed in secure formats that prevent font extraction.

C. THIRD-PARTY PRINTING
The Licensee may share Fonts with a commercial printer or service bureau solely for outputting a specific document, provided the Fonts are used only for that project and no copies are retained. The Licensee assumes responsibility for any misuse by third parties.

D. STATIC IMAGES
The Licensee may create static images (e.g., JPEG, TIFF, PNG) featuring the Licensed Fonts, as long as these images are rasterized and do not allow font outline extraction. Using static images of the Fonts on a website requires a Web Licence.

 

2.1.4 FONT FORMATS & LIMITATIONS
—
Desktop Fonts are optimised TTF files (static and variable) exclusively for desktop usage. Converting Desktop Fonts into web font formats (e.g., Cufon, WOFF, WOFF2, EOT, SVG, TTF, etc.), is not permitted. Embedding the Font Software into web pages is not permitted and requires a Web Licence (§2.2). 

A separate Logo Licence is required for use in logotypes (§2.3).

Desktop Fonts may not be used beyond the scope of the Desktop Licence, including its use in apps, games, ePub files, servers, merchandise, film titles, credits, television, online transmissions, or social media. These uses require a Licence Extension (§2.4).

 

WEB END USER LICENCE AGREEMENT

 

2.2.1 GRANT OF LICENCE

Upon full payment of the non-refundable Web Licence Fee, the Licensee acquires a perpetual, worldwide right to self-host the Font Software for styling text on websites. This right is non-exclusive, non-transferable, and non-sublicensable.

 

2.2.2 LICENSEE INFORMATION & COMPANY SIZE

The person placing the order must provide the name of the Licensee or Company using the Fonts and specify the Company Size, which is the total workforce of the company (including employees, shareholders, directors, proprietors, subcontractors, and freelancers that are under the Licensee’s control) across all locations, regardless of their access to the Fonts.

2.2.3 RIGHTS & RESTRICTIONS

A. SELF-HOSTING REQUIREMENT
The Fonts may only be used as Self-Hosting Web Fonts with CSS @font-face to style text on the Licensee's website. Other technologies for font embedding are not permitted. Best Typefaces does not collaborate with or permit the hosting of its Font Software on any cloud-based hosting service. The Company Size count must not exceed that specified in the Order Invoice.

B. PROHIBITED EMBEDDING METHODS
Only the CSS @font-face rule is allowed for embedding. Embedding or linking by other methods—including for PDFs, EPUBs, native or mobile apps for iOS, Android, or Windows, Cufón, or sIFR—is strictly prohibited. The Licensee agrees to prevent any hot-linking, re-serving, or redirecting access to the Font Software, including use of external font hosting services.

C. DOMAINS & TRAFFIC
The Web Licence covers all domains and subdomains operated under the control of the Licensee. The Licence Fee is determined exclusively by Company Size. There is no restriction on the number of domains or volume of web traffic, provided all usage remains within the scope of the Licensee’s organisation.

 

D. THIRD-PARTY USE
The Licensee may share Fonts with third parties only if they are under the Licensee's direction and are using the Font Software exclusively for the Licensee's projects (e.g., web developers working on the Licensee's website who are not in-house but require access to the Fonts).

 

E. USAGE RESTRICTIONS FOR REMOTE EDITING
Viewing and printing pages of the website using the Font Software is permitted. However, allowing remote users to edit text with the Fonts to create new documents or products (e.g., personalised invitations, greeting cards, customised portfolios) is not allowed. Licences for such uses are available upon request.

 

2.2.4 FONT FORMATS & LIMITATIONS
—
Best Typefaces provides webfont packages in WOFF and WOFF2 formats, optimised for dynamic rendering on websites. Unsupported formats, including SVG, EOT, TTF, and OTF, are not provided and may not be used.

 

LOGO END USER LICENCE AGREEMENT

 

2.3.1 GRANT OF LICENCE

—

Upon full payment of the non-refundable Logo Licence Fee, the Licensee acquires a perpetual, worldwide right to use the Font Software to create a single primary logo for one brand. This right is non-exclusive, non-transferable, and non-sublicensable. The resulting logo may be used across all media, including but not limited to print, packaging, social media, broadcast, websites, signage, and physical products.

 

2.3.2 LICENSEE INFORMATION & COMPANY SIZE

—

The person placing the order must provide the name of the Licensee (i.e., the company or brand the logo is being created for) and specify the Company Size, defined as the total workforce of the Licensee (including employees, shareholders, directors, proprietors, subcontractors, and freelancers under their control) across all locations.

 

If the purchaser is a design agency or third party working on behalf of a client, the Logo Licence must reflect the Company Size of the client brand, not that of the purchasing agency.

2.3.3 RIGHTS & RESTRICTIONS

—

A. SCOPE OF USE

The Logo Licence permits the use of the Licensed Fonts to design a single primary logo for one brand. The resulting logo may be used freely in any medium or format. If additional logos are required for different brands, a separate Logo Licence must be purchased for each.

 

B. SECONDARY LOGOS & VARIATIONS

The Licence also allows the creation of secondary or alternate logo versions for the same brand, such as horizontal and vertical lock-ups, icon-only marks, tagline variations, or responsive/adaptive versions, provided they are clearly part of the same brand identity. All such variants must be created by converting the Font Software to vector outlines. The Font Software itself may not be embedded or used in live text for these applications.

 

C. FONT OUTLINE CONVERSION, DISTRIBUTION, AND RESTRICTIONS

The Licensee is permitted to convert the Font Software into vector outlines within design software for the purpose of creating or refining the logo. The final logo artwork (expressed as vector paths) may be freely distributed and used as part of the brand’s identity. However, the Licensee may not distribute, share, embed, or otherwise make available the original Font Software or any editable font files. Any such use is strictly prohibited and requires a separate Licence.

 

2.3.4 FONT FORMATS & LIMITATIONS

—

This Licence grants rights only for the creation and use of a single logo and related variants for one brand. It does not permit the use of the Font Software for general desktop publishing, websites, applications, social media posts (beyond the logo), motion graphics, merchandise, or any other use outside the defined logo scope. For such uses, the appropriate Licence (e.g., Desktop, Web, or any other use detailed in §2.4 (Licence Extensions) must be obtained.

 

Any use of the Font Software beyond the scope outlined in this Agreement requires a Licence Extension from Best Typefaces. This includes, but is not limited to, the following scenarios:

2.4.1 LARGER DESKTOP LICENCE

Required when the Licensee’s Company Size exceeds the maximum permitted under the standard Desktop Licence (100 employees). This Licence Extension allows continued desktop use across a larger organisation and ensures proper coverage for additional users.

 

2.4.2 LARGER WEB LICENCE
—
Required when the Licensee’s Company Size exceeds the maximum permitted under the standard Web Licence (100 employees). This Licence Extension authorises use of the Web Fonts by organisations with larger internal teams while maintaining unlimited traffic and domain scope.

 

2.4.3 LARGER LOGO LICENCE
—
Required when the Licensee’s Company Size exceeds the standard limit of 100 employees. This Licence Extension permits the creation and use of logos, wordmarks, slogans, and other brand assets at scale, across high-reach organisations or enterprise-level brands.

 

2.4.4 APP LICENCE
—
Required for embedding fonts within mobile, desktop, or web applications to render text across devices like smartphones, tablets, and personal computers.

 

2.4.5 CUSTOM FONT LICENCE
—
Tailored to the creation of completely unique typefaces or font systems designed specifically for your project or brand.

 

2.4.6 FONT MODIFICATIONS LICENCE
—
Covers requests for any adjustments to the typeface design, such as adding characters, expanding language support, or altering stylistic features.

 

2.4.7 BROADCAST LICENCE
—
Allows the use of fonts in broadcast media, including television, cinema, streaming services, digital signage, and point-of-sale (POS) displays. Licence terms are based on the geographic broadcast range.

2.4.8 SOCIAL MEDIA LICENCE

—
Covers the use of fonts in posts, stories, videos, or paid advertisements across social media platforms. Pricing depends on your total follower count or reach.

 

2.4.9 ONLINE ADVERTISING LICENCE
—
Permits the use of fonts in digital advertising formats, such as banners, email campaigns, pop-ups, and video ads on websites or apps.

 

2.4.10 OUT-OF-HOME (OOH) LICENCE
—
Applies to fonts used in outdoor and public advertising spaces, including billboards, transit ads, street furniture, and vehicle wraps.

 

2.4.11 MERCHANDISE LICENCE
—
Allows the integration of fonts into products like apparel, packaging, promotional items, and other commercial goods.

2.4.12 ELECTRONIC DEVICE DISPLAY LICENCE
—
Covers the embedding of fonts in device interfaces, such as ticket machines, ATMs, household appliances, and entertainment systems.

 

2.4.13 VIDEO GAMES LICENCE
—
Grants permission to use fonts in video games on various platforms, including consoles, PCs, and mobile devices.

 

2.4.14 SERVER LICENCE
—
Authorises the installation of fonts on servers to dynamically render content for websites, documents, or apps. Excludes usage in software-as-a-service (SaaS) where the font itself is the core offering.

 

2.4.15 ELECTRONIC PUBLICATIONS (ePub) LICENCE
—
Applies to the use of fonts embedded in digital publications such as eBooks, PDFs, and online journals distributed electronically.

FREE TRIALS END USER LICENCE AGREEMENT

 

2.5.1 GRANT OF LICENCE
—
This Free Trial Licence grants the Licensee access to our entire Font Catalogue at no cost, strictly for non-commercial use, including:

◆ Private evaluation, concept development, and testing.
◆ Client presentations and proposals.
◆ Student projects and academic use.
◆ Use by non-profit organisations.

By downloading and using the Trial Fonts, the Licensee agrees to the Terms of this Licence Agreement and the General Terms.

2.5.2 STUDENTS
—
Students can use these Trial Fonts for both private and public non-commercial projects, including study-based and personal projects. After graduation, a Commercial Licence is required for professional work. 

2.5.3 NON-PROFIT ORGANISATIONS

—
Charities and Non-Profit Organisations may use the Fonts for non-commercial branding and materials (they must comply with our Ethical Limitations (§1.4.J). Any commercial activities will require a Commercial Licence. 

 

2.5.4 CREDITING
—
Proper attribution is required as outlined in the Crediting Section (§1.15).

2.5.5 FONT FORMATS & LIMITATIONS
—
Our Free Trial Fonts are fully functional, with full OpenType features and the complete character set. Only Desktop (TTF) formats are available, if you require additional formats please get in touch. The Free Trial Fonts are distinguished from Commercial Fonts by the word “TRIAL” in the font family name, for example, “Best TRIAL.”

 

Best Typefaces does not provide any technical support under this licence, the Font Software is provided on an ’as is’ basis without any warranties of any kind. The Fonts cannot be resold, modified, or used commercially without a Commercial Licence.

 

3.1 PLACING THE ORDER
—
The Licence Type is determined based on the intended use of the Font Software. During the purchase process, the person placing the order must provide the name of the Licensee or Company that will be using the Fonts, ensuring that all information provided is accurate and that the End User agrees to the Licence Terms.

The Licensee or Company must also select the specific Licence Type(s) of the Font Software needed. Fonts may not be used for the benefit of unlicensed third parties, such as the Customer’s customers. If a third party wishes to use the Font Software, the Customer or the third party must obtain an appropriate Licence.

Upon full payment of the non-refundable Licence Fee, this Agreement grants the Licensee a non-exclusive, non-transferable, perpetual right to use the Font Software within the terms and specifications stated in the Order Invoice.

3.2 ORDER CONFIRMATION
—
An Order Invoice confirmation will be sent via email to the Licensee as official confirmation of the selected Licence Type(s). This document will detail usage terms, associated fees, and other specifications of the licence.

 

3.3 USER RESPONSIBILITY
—
If the Licensee exceeds the agreed scope of use for three consecutive months, they must immediately notify Best Typefaces. In this case, a one-time upgrade fee will be required, calculated based on the difference between the initial Licence fee and the current fee for the new scope. Best Typefaces reserves the right to monitor or inspect usage, as outlined in the Business and Organisational Users; Audits (§1.8).

If the intended use extends beyond the Standard Licences (e.g., larger Desktop or Web licences or other uses like branding, server licences, streaming, TV, or merchandise), the Licensee must obtain a Licence Extension for an additional fee.
